Friends, does this sound like you? You’re a Virginia resident, your car got repossessed by the bank, they sold it for less than you owed, and now Bank is suing you for the deficiency?  Most people assume that the situation is hopeless.

NO!  Virginia lenders who repossess and re-sell collateral (meaning: your car, but could be your boat, your trailer, your RV, your motorcycle, your airplane, etc.) must do it exactly according to law. Our state has some precise rules about how lenders are to proceed with repo and re-sale. Virginia law gives debtors (borrowers) some substantial and very welcome protections following a lender’s misstep. However, those protections are not automatic, and putting on a courtroom defense is, for most folks, not a do-it-yourself maneuver.

We know some things about using Virginia law against Lender banks who mis-stepped!

If you’d like to explore your situation with us to see if your lender has made a mistake that might be used to protect you, give us a call!

Hello,

My Name is Quincy Walker Jr.

- I made a payment and contacted Ally Financial Immediately after. (Around 8 am)
- I spoke to a woman who said that she sees my payment processed.
- My car was repossessed on DEC 3 Around 12:13 pm
- I attempted to contact Ally Financial Redemption Center (December 3rd 2021 Around 1 pm) from to see what my next steps were to receive the vehicle)
- The two different employees informed me that my repo has not been closed. But Upper Management (Redemption Center) was unavailable.
- From DEC 3-DEC 6. I contacted the redemption department. On DEC. 6 (1:09 pm) I was able to speak to a member of Upper Management. They informed me that my repossesion was closed. We conversed about the timing of the repossession. Same result.
- I then reached out for legal aide.

-I have spoken to them today they informed me that I have 15 days to get it out of repossesion for 2188.86.
- I will not be able to pay this until January 1st. So my vehicle will be taken. But can you inform me on how to go about this situation. Or options that may be available?

Feel free to reach me via email or phone (513)707-8023

Your car is connected to the drag the truck. You’d been fighting for months to make payments, and now the thing you are scared maximum has come true: repossession. And you consider to yourself: What do I do now? Where is my car? Is there some kind of car repossession search for service that can trail it down? We’ll begin by letting you know that it’s your lender’s accountability to divulge you after repossession about the authority of your car. If you discover that your vehicle is missing, you have two options. Initially, you should call the lender. Next, call the local police department. Further that, there are laws to safeguard you without having to file for debt and some things you can do to safeguard yourself and possibly recover your car.
