A judge has suppressed all of the video footage recorded inside the day spa, effectively gutting the prosecution’s case. The warrant was found to be flawed and the camera placement was deemed too intrusive. During the five days that the cameras were in operation, they were pulling over everyone leaving the spa and examining their identification, supposedly on the pretense of a traffic stop, but in most cases, there had been no traffic violation and no tickets were issued.
Further example why you take a lawyer to court with you to face criminal charges. You are not guilty until the judge says you are guilty. Between the time you get arrested and the time a judge or jury announces a verdict, the government just might screw up once or twice, or in the case of Robert Kraft, at least three separate and very meaningful ways.
The way our constitution and criminal procedural laws work, the government has to do it absolutely correctly, or the charge/allegation fails. But almost always, their missteps are technical, and need to be called out by a technician – a defense lawyer!
